Abstract

This article evaluates anti-trafficking policy by examining how legal rules are carried into routine administrative practice rather than by counting the rules that have been adopted. Kazakhstan enacted a dedicated anti-trafficking law in 2024 and brought previously dispersed provisions into a more coherent framework. Whether this change improves early victim identification, the detection of forced labour, and interagency accountability remains a separate question. The study examines the normative, operational, and outcome gaps between international standards and the national reform. It uses qualitative policy and legal analysis of nine core international and national documents issued between 2000 and 2024, together with a targeted review of 41 scholarly works, including 40 peer-reviewed articles and one scholarly monograph. The material was coded across legal definition, prevention, victim identification and referral, protection and recovery, prosecution and non-punishment, and coordination and data. The analysis finds that the 2024 reform reduces normative fragmentation, but formal alignment does not by itself secure effective delivery. Vulnerable points remain in frontline decision-making, labour inspectors' capacity to recognise coercion, access to assistance when a person does not participate in criminal proceedings, and the compatibility of administrative data across institutions. The article therefore treats anti-trafficking governance as a chain running from normative alignment through operational access to measurable rights-based outcomes. It recommends a shared identification protocol, risk-based labour oversight, secure interagency data exchange, and indicators that capture access to protection and sustained recovery.
